Cinder — Terms of Service
Cinder is a game. It is played on a phone, it keeps its progress on that phone — and, once you have an account, on our server too — and it sells gems and one character through your app store. These terms say what you can expect from it and from us.
1. Agreeing to these terms
By installing or playing Cinder you agree to these terms. If you do not agree, do not use the game. Cinder is published by BrotherAI ("we", "us"). These terms are in addition to the terms of the app store you installed from.
2. Who may play
You must be old enough to hold an account with the app store you installed from, and old enough to make a purchase there if you choose to. Signing in requires a Google or Apple account under those providers' own rules; a purchase needs either such an account or a guest account (see the Privacy Policy). Cinder is not directed to children.
3. What Cinder is and is not
Cinder is a single-player arcade game: runs of a few minutes against waves of enemies in an arena that catches fire. In particular:
- It is played offline. There is no multiplayer and no leaderboard. The daily run is generated from the date on your device. You do not need an account to play. You need one to buy something, and it keeps your progress in the cloud.
- Its numbers — gold, gems, levels, times — are game values with no cash value, and cannot be transferred, sold or exchanged.
- Nothing in the game is bought with real money at random: every purchasable thing is named before you pay.
4. Purchases
The game is free to play, and every character and arena but one can be unlocked by playing. Three things are sold, through your app store: two packs of gems, which are consumed when spent, and the Glassheart, a character that only a purchase unlocks. Gems buy time on the same ladder play climbs; nothing bought opens the game, and nothing is sold at random.
Payment, receipts and refunds are handled by the store under its own terms. A gem pack is credited to your game the moment the store confirms it and cannot be restored once consumed; the Glassheart belongs to the Cinder account that bought it and can be restored on any phone signed in to that account. A guest account lives only on its phone; link Google or Apple to it to keep what it bought. Prices may change; a change never affects what you have already bought.
5. Your data
Your progress and settings are stored on your device. If you have an account, a copy is also saved to our server under it — see the Privacy Policy for exactly what is sent.
The practical consequence is important: we can only restore what was saved to the cloud. If you never make an account, play as a guest and lose the phone, or the last sync did not complete, whatever was not covered by your own device backup is gone when the game is uninstalled or the device is lost. Saves are never merged. When the same account is played on two devices and only one of them has played since the last sync, that device's save is kept; if both have, the game asks you which save to keep and the other is replaced — so play on one device at a time. Gems you paid for stay either way. The server refuses a save that would overwrite a newer one.
6. Acceptable use
Do not attempt to reverse engineer, decompile or tamper with the game or its server beyond what your local law expressly permits, and do not attempt to obtain gems, the Glassheart or a cloud save that is not yours without paying for or earning them. The game and its content — code, artwork, sound, text — are ours and are licensed to you for personal, non-commercial use, not sold.
7. Availability and changes
We may change, add or remove features in future versions, including the balance of weapons, enemies and prices in gems, and we may stop publishing Cinder. The cloud-save server may be unavailable at times and may be discontinued; the game says so on its home screen and keeps working from the save on your device. If we discontinue the game, the version installed on your device keeps working offline as long as your operating system supports it.
8. Disclaimer of warranties
Cinder is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose or non-infringement. We do not warrant that the game or its server will be uninterrupted or error-free, or that the game will run at any particular frame rate on any particular device. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.
9. Limitation of liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, nor for lost data or lost progress, arising from your use of Cinder. Our total liability for any claim relating to the game is limited to the amount you paid for it in the 12 months before the claim.
Nothing in these terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, or for fraud.
10. Changes to these terms
We may update these terms. Material changes will be reflected on this page with a new "Last updated" date before the version they apply to ships. Continuing to play after that means you accept the updated terms.
11. Governing law
These terms are governed by the laws of Vietnam, without regard to conflict-of-law rules. This does not remove any protection you have under the mandatory consumer law of the country you live in.
